Terms of Service

Open Sound New Orleans is a community media project. The idea is to share recordings of the sounds of our city. This is an open-source project, meaning that we believe in the ability of the community as a whole to use the source materials contributed by users to the site, under certain conditions.

All contributions to the site fall under the Creative Commons Attribution-Noncommercial 3.0 license. You should read more about that here: http://creativecommons.org/licenses/by-nc/3.0/. By uploading sounds to the project, you are certifying that you have a legal right to do so - that it doesn't infringe on any third party or copyright - and that your sound can be released under the Creative Commons Attribution-Noncommercial 3.0 license.

  • Your sound can be used by others for noncommercial purposes.

What it means in plain language is that, when you upload a sound to the site, others can download it, share it, and repurpose it as long as the use is noncommercial and they attribute you and Open Sound New Orleans. When you contribute a sound to the site, you and your sound become an integral part of this project. As such, any other uses of your sound by site visitors will require attribution of both you and our project, Open Sound New Orleans.
Of course, you can always use your own recordings in any way you see fit - we do not own them or claim any exclusive rights to them. We simply require that the contributions you make to the project, Open Sound New Orleans, in the manner you offer them, be available to others under the terms of the Creative Commons Attribution-Noncommercial 3.0 license.

  • Attribution means others using the information you provide.

Those who might choose to use your sounds, including Open Sound New Orleans, agree to attribute you when they do so. They will attribute you using the information you choose to provide about yourself when you contribute. If you want your proper name attributed, you affirm that by using your proper name in the sound bubble or providing it in your user profile. Any information you choose to provide to describe yourself or your sound can and probably will be used to attribute you.
One of the unifying ideas behind this project is giving credit where credit is due. We don't want to embarrass you, so please don't contribute something you don't want spread around or use your name if you don't want it used.
By uploading sounds to this project site, you understand that Open Sound New Orleans fulfills its obligation to attribute you by giving you credit on the site. On occasion, Open Sound New Orleans may use sounds contributed to the site in features for promotion of the project. If we use your sound, we'll do our best to contact you in such an event, but cannot guarantee it. In all cases, we will direct listeners to the site for more information - including your attribution. We may remix sounds contributed and broadcast them on the radio - we can't always name all contributors in a context such as that. However, we promise to always direct listeners to where they can find out more information about you and your contribution - the website.
Oh yeah, we also reserve the right to remove anything at any time for any reason.

If you choose to link to, remix, broadcast, transmit, or otherwise use sounds from the Open Sound New Orleans site, the use must confirm to the Creative Commons Attribution-Noncommercial 3.0 license. You need to shout out the person who contributed the sound - by whatever name they have provided in their user profile. We ask that you also reference Open Sound New Orleans. If the use is in a website, please provide a link to http://opensoundneworleans.com.
